Game with no gamesave is displayed incorrectly highlighted green in title list

I have the legit title DKC: Tropical Freeze (USA) installed in USB HDD. I don't have any gamesave created for this game. Data Management of System Settings correctly displays GAME and UPDATE items and no SAVEDATA item for this title. But when I run Savemii 1.2.0.mod5 from Homebrew Launcher Channel (I use CBHC), it shows me this title incorrectly highlighted green in the title list. And, if I also choose to backup the supposed gamesave it generates an empty folder ..\backups\0005000010137f00\0 on the SD card.

Right now the green means that the game has the folder structure and metadata.

• has folders up to /usr/save/00050000/XXXXXXXX/user
• has file /usr/save/00050000/XXXXXXXX/meta/meta.xml

If there are no persistent ID folders inside /user it still shows green because doesn't have to create folders up to /user (haven't tested what happens if savemii creates those folders without the right permissions).
If you go to backup and change from "all users" to specific user, it will show if the game has a save for that user ("Empty"/"Has Save").
