This Contributor License Agreement ("CLA") governs contributions to software, documentation, configuration, infrastructure code, and other project-related materials maintained, operated, or controlled by GrowVolution e.V.

In this CLA, GrowVolution e.V. is referred to as the "Organization", "Association", or "GrowVolution".
This CLA applies to all repositories, projects, software packages, documentation, configuration, infrastructure code, and other project-related materials that are maintained, operated, hosted, or controlled by GrowVolution e.V. within its organization account.
This includes, without limitation:
- public repositories;
- private, internal, restricted, or non-public repositories;
- contributions made through membership in the organization;
- contributions made through repository access, team access, maintainer access, or any other form of organizational permission;
- contributions to software, documentation, configuration, CI/CD, infrastructure, tests, examples, issue templates, workflows, deployment files, and related materials;
- changes, modifications, improvements, optimizations, adaptations, extensions, translations, refactorings, patches, fixes, reviews, and other contributions.
This CLA applies regardless of the technical method by which a contribution is submitted, including pull requests, commits, patches, uploads, issue comments, code reviews, direct repository access, email, chat, or any other form of submission.
A "Contribution" means any work, material, change, addition, improvement, optimization, modification, adaptation, correction, documentation, or other input submitted to, included in, or made available for a project covered by this CLA.
Contributions may include, without limitation:
- source code;
- object code or binary files;
- scripts;
- configuration files;
- documentation;
- text;
- translations;
- designs;
- data models;
- tests;
- build files;
- deployment files;
- CI/CD workflows;
- infrastructure-as-code;
- examples;
- issue templates;
- project metadata;
- concepts, to the extent they are implemented in a legally protectable form;
- any other project-related material.
A "Contributor" means any natural person or legal entity that submits, provides, uploads, commits, proposes, or otherwise makes a Contribution.
The "Organization Account" means the GitHub organization account and any related technical project spaces, repositories, systems, platforms, or services operated, maintained, hosted, or controlled by GrowVolution e.V.
GrowVolution e.V. centrally manages the rights in all repositories, projects, and software maintained in the Organization Account.
To the extent legally possible, the Contributor assigns and transfers to GrowVolution e.V. all rights, title, and interest in and to each Contribution submitted by the Contributor.
Where an assignment or transfer of rights is not legally possible, including where applicable copyright law does not permit a full transfer of authorship or copyright, the Contributor grants GrowVolution e.V. an exclusive, irrevocable, perpetual, worldwide, transferable, sublicensable, royalty-free, fully paid-up, and unrestricted license to use, exploit, modify, distribute, publish, relicense, and otherwise deal with the Contribution in any manner.
This rights grant applies to all Contributions to repositories maintained in the Organization Account, including private and non-public repositories and Contributions made on the basis of organizational membership, internal access, maintainer rights, team membership, or other forms of permission.
The rights granted under this CLA include, without limitation, the right of GrowVolution e.V. to:
- use the Contribution;
- reproduce the Contribution;
- modify, adapt, optimize, refactor, translate, or otherwise change the Contribution;
- create derivative works based on the Contribution;
- combine the Contribution with other works, software, repositories, services, or platforms;
- publish or make the Contribution available;
- distribute the Contribution;
- publicly display or communicate the Contribution;
- use the Contribution in public, private, internal, restricted, or commercial repositories and systems;
- include the Contribution in open-source, proprietary, dual-licensed, internal, or commercial projects;
- sublicense the Contribution;
- grant simple or exclusive rights to third parties;
- relicense the Contribution under any license chosen by GrowVolution e.V.;
- commercially and non-commercially exploit the Contribution;
- remove, replace, or discontinue use of the Contribution;
- enforce rights in the Contribution against third parties.
The rights granted are not limited to a specific repository, product, project, technical implementation, license model, business model, or purpose.
GrowVolution e.V. may identify itself as the copyright holder, rights holder, maintainer, publisher, or license administrator for repositories, projects, and software maintained in the Organization Account.
Unless a repository specifies otherwise, copyright notices may be stated as:

The Contributor acknowledges that GrowVolution e.V. may manage and present the relevant rights centrally, including for Contributions made to private repositories or through internal organizational access.
If a repository is published under an open-source license, that license governs the rights of downstream users of that repository.
This CLA governs the legal relationship between the Contributor and GrowVolution e.V. It is intended to allow GrowVolution e.V. to maintain a consistent rights position across its repositories and to support, among other things:
- continued maintenance;
- internal use;
- private repository use;
- relicensing;
- dual licensing;
- commercial licensing;
- publication under open-source licenses;
- publication under proprietary licenses;
- integration into platforms, services, packages, Additives, deployments, and other projects;
- use within the technical infrastructure and organizational purposes of GrowVolution e.V.
The Contributor represents and warrants that:

the Contributor has the legal right to submit the Contribution under this CLA;

the Contribution is the Contributor's original work or the Contributor is otherwise authorized to submit it under this CLA;

the Contribution does not knowingly infringe the rights of any third party;

the Contribution does not knowingly include material under a license that is incompatible with the relevant repository or with this CLA;

the Contribution does not contain confidential information of any third party unless the Contributor is authorized to provide it;

the Contribution does not contain personal data, passwords, API keys, access tokens, private keys, certificates, credentials, trade secrets, or other sensitive information unless expressly authorized by GrowVolution e.V.;

the Contributor will notify GrowVolution e.V. without undue delay if the Contributor becomes aware that a Contribution may not have been validly submitted under this CLA.
If the Contributor submits a Contribution in the course of employment, service, agency, contract work, membership in another organization, or any other relationship with a third party, the Contributor represents that the Contributor has the required authority to submit the Contribution and grant the rights under this CLA.
If there is any uncertainty about the Contributor's authority, the Contribution must not be submitted until the required approval has been obtained.
GrowVolution e.V. may require a separate confirmation or a separate corporate contributor license agreement for Contributions made on behalf of an employer, client, company, association, or other legal entity.
Unless expressly agreed otherwise in writing, Contributions are submitted voluntarily and without compensation.
The Contributor is not entitled to payment, reimbursement, royalties, revenue share, profit participation, license fees, membership benefits, or any other consideration solely because of a Contribution.
The Contributor expressly agrees that Contributions may be used in private, internal, restricted, or non-public repositories and systems operated or controlled by GrowVolution e.V.
This includes, without limitation:
- internal platforms;
- association infrastructure;
- production systems;
- test and development environments;
- commercial or non-commercial software offerings;
- Additives, modules, services, deployments, and other technical components;
- repositories accessible only to members, maintainers, board members, contractors, service providers, or other authorized persons.
The Contributor agrees that GrowVolution e.V. and persons authorized by GrowVolution e.V. may modify, adapt, improve, optimize, refactor, extend, reduce, restructure, translate, document, integrate, remove, replace, or otherwise further develop Contributions.
GrowVolution e.V. is not required to accept, merge, publish, maintain, preserve, mark, identify, or continue any Contribution in any particular form.
GrowVolution e.V. may license, sublicense, relicense, or otherwise make available Contributions and works derived from Contributions under any license or licensing model chosen by GrowVolution e.V., subject to mandatory law and valid third-party rights.
This includes, without limitation:
- open-source licenses;
- proprietary licenses;
- dual licensing models;
- internal use models;
- commercial licenses;
- free-of-charge licenses;
- licenses to members, partners, service providers, customers, contractors, or other third parties.
To the extent legally permitted, the Contributor waives any requirement to be named in connection with every use, publication, modification, distribution, sublicensing, or relicensing of a Contribution.
GrowVolution e.V. may, but is not required to, identify Contributors in commit histories, release notes, contributor lists, documentation, acknowledgements, or other project materials.
No Contributor has a claim to any specific form, prominence, or permanence of attribution unless expressly agreed otherwise in writing.
GrowVolution e.V. is not obligated to use, accept, merge, review, publish, maintain, or retain any Contribution.
GrowVolution e.V. may reject, modify, remove, revert, replace, archive, delete, or discontinue any Contribution or project at its discretion, subject to applicable law and internal governance rules.
The rights granted under this CLA are irrevocable to the maximum extent permitted by law.
A later resignation from the association, termination of repository access, removal from the Organization Account, end of team membership, end of a role, or termination of cooperation does not affect rights already granted for Contributions submitted before that time.
GrowVolution e.V. is not required to remove or stop using Contributions that were validly submitted under this CLA.
The Contributor must not submit confidential information, personal data, credentials, API tokens, passwords, private keys, certificates, secrets, or other sensitive information unless expressly authorized by GrowVolution e.V.
If such information is submitted by mistake, the Contributor must notify GrowVolution e.V. without undue delay.
This CLA applies regardless of whether the Contributor is a member of GrowVolution e.V.
Granting repository access, organization membership, maintainer rights, team access, or other technical permissions does not create any entitlement to keep such access.
GrowVolution e.V. may change, restrict, suspend, or revoke access rights in accordance with its internal responsibilities, statutes, rules, security requirements, and applicable law.
By submitting a Contribution, the Contributor confirms that the Contributor has read and agrees to this CLA.
Acceptance may occur through, without limitation:
- creating a pull request;
- committing directly to a repository;
- submitting a patch;
- uploading or transmitting files;
- participating in a public or private repository;
- submitting a review, change request, or proposed change;
- providing written or electronic confirmation;
- accepting a technical CLA process;
- otherwise making a Contribution to a project covered by this CLA.
GrowVolution e.V. may require Contributors to document acceptance separately, for example by signature, checkbox, pull request comment, email confirmation, or an automated CLA system.
This CLA is governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules to the extent legally permitted.
Where legally permissible, the place of jurisdiction is the registered seat of GrowVolution e.V.
If any provision of this CLA is or becomes invalid, unenforceable, or incomplete, the validity of the remaining provisions remains unaffected.
The invalid, unenforceable, or incomplete provision shall be replaced, to the extent legally permissible, by a valid and enforceable provision that most closely reflects the legal and economic purpose of the original provision.
This CLA applies from the date it is published in the Organization Account unless a later version states otherwise.
GrowVolution e.V. may update this CLA from time to time. Unless a later version provides otherwise, updated versions apply to Contributions submitted after publication of the updated version.
Previously submitted Contributions remain governed by the version accepted at the time of submission, unless the Contributor expressly accepts the updated version.
