Update RGGI representation

Summary

Recent legislation in Virginia and Maine requires updates to the RGGI representation.

Updates include:

• Virginia is rejoining: HB 29 (Item 365, Part R) directs the Department of Environmental Quality to file regulations (within 90 days of 02/20/2026) that enable participation in RGGI; regulations and carbon emissions caps must be updated by 2027 to align with most recent program review
• Maine has changed their allowances: L.D. 2037 updates electricity sector carbon emissions caps from 2027 through 2037; the new cap requires a 90% reduction in electricity emissions; see Title 38, Chapter 3-B: REGIONAL GREENHOUSE GAS INITIATIVE
  • Repealed: "The department shall adopt rules to implement the program. Rules must be consistent with the model rule. The rules must include, but are not limited to: ... C. Provisions for the establishment of carbon dioxide offset project allowance categories and requirements"
  • Repealed: "The department, the Public Utilities Commission and the trustees of the Efficiency Maine Trust established pursuant to Title 35‑A, section 10103 shall submit a joint report... The report must assess and address: ... D. Research and support of new carbon dioxide offset allowance categories for development in the State"
  • Repealed: "Nothing in this chapter may be construed to limit: ... 2. Categories of carbon dioxide emissions offset projects. The categories of carbon dioxide emissions offset projects that may qualify under agreements among the states and jurisdictions participating in the regional greenhouse gas initiative, particularly with respect to additional categories that take advantage of the geographical, economic or natural resources of this State."
