PRODUCT/LEGAL: Update Terms & Conditions for platform-specific content restrictions #9020

Description

@julianjelfs

Context

OpenChat's current Terms & Conditions describe what content is allowed on the platform as a whole. With the introduction of app store builds (Android/iOS), there are additional content restrictions imposed by Google Play and Apple App Store policies that apply specifically to those platforms.

The T&C needs to be updated to make clear that:

  1. Some content is allowed on the OpenChat platform generally (e.g., adult content in communities flagged as such) but is not accessible via the app store builds
  2. Users agree that platform-specific restrictions may apply when using the app via a third-party app store
  3. The distinction between what is a T&C violation (subject to sanctions) vs what is simply hidden in certain contexts

Suggested language (to be reviewed by legal)

Add a section such as:

Platform-specific restrictions
OpenChat operates across multiple platforms, some of which impose their own content policies. When accessing OpenChat via a third-party app store (such as Google Play or Apple App Store), additional restrictions apply as required by those platforms' policies. Content that is permitted on the OpenChat platform generally may not be accessible in those contexts. These restrictions apply to the interface only and do not constitute a violation of these Terms.

Work required

  • Draft updated T&C language covering platform-specific restrictions
  • Ensure the distinction between "T&C violation (sanction)" vs "platform-restricted (hidden)" is clearly articulated
  • Review with legal counsel if available
  • Publish the updated T&C and update the version/date in the app

Acceptance criteria

  • Updated T&C clearly explains that app store builds have additional content restrictions
  • Users can understand why certain content is hidden in the app store build without it implying they have violated any rule
  • The updated T&C is live before the app store submission
