[Runt] Defect - used check flag when checkmate was needed

What steps will reproduce the problem?

see attached image.  Black queen is killing a piece in this move

What is the expected output?

Black should have used the checkmate flag

What do you see instead?

black used the check flag.

What version of the product are you using?
1.02

On what operating system?
Windows Vista
